Terms of Service.

Welcome to Plot-on! These Terms of Service (“Terms”) are a legally binding agreement between you and Plot-on, LLC, a California limited liability company (“Plot-on,” “we,” “us,” or “our”), governing your access to and use of the Plot-on website, applications, and related services (collectively, the “Service”).

PLEASE READ THESE TERMS CAREFULLY. BY CREATING AN ACCOUNT OR USING THE SERVICE, YOU AGREE TO BE BOUND BY THESE TERMS, INCLUDING THE ARBITRATION AGREEMENT AND CLASS ACTION WAIVER IN SECTION 15, WHICH AFFECT YOUR LEGAL RIGHTS. IF YOU DO NOT AGREE, DO NOT USE THE SERVICE.

SECTION 1The Service

Plot-on is a story-plotting tool for writers. The Service lets you create and organize projects (“Plots”), scenes, characters, plotlines, and related creative material, and includes features for structuring and visualizing your stories, such as boards, cards, and timelines. We may add, change, or remove features at any time, and we may introduce features that use artificial intelligence to assist your writing (see Section 7).

SECTION 2Eligibility

You must be at least 13 years old (or the minimum age required in your country to use online services without parental consent) to use the Service. If you are under 18, you may use the Service only with the consent of a parent or legal guardian who agrees to these Terms on your behalf. By using the Service, you represent that you meet these requirements.

SECTION 3Your Account

To use most features, you must create an account with an accurate email address and a secure password. You are responsible for safeguarding your credentials and for all activity that occurs under your account. Notify us immediately at support@plot-on.com if you suspect unauthorized use of your account. We are not liable for losses caused by unauthorized use of your account that results from your failure to keep your credentials secure.

SECTION 4Plans, Billing, and Cancellation

4.1 Free and Paid Plans

The Service is offered on a freemium basis: a free plan with core functionality and paid subscription plans (“Paid Plans”) with additional features. Features included in each plan are described on our pricing page and may change over time. We will provide reasonable notice of material reductions to a Paid Plan you are actively subscribed to.

4.2 Billing and Auto-Renewal

Paid Plans are billed in advance on a recurring basis (monthly or annually, depending on the plan you choose) through our third-party payment processor. BY SUBSCRIBING, YOU AUTHORIZE US TO CHARGE YOUR PAYMENT METHOD ON EACH RENEWAL DATE UNTIL YOU CANCEL. Prices may change; we will notify you at least 30 days before a price change takes effect, and the new price will apply from your next renewal.

4.3 Cancellation and Refunds

You may cancel your Paid Plan at any time in your account settings. Cancellation takes effect at the end of the current billing period, and you will retain Paid Plan access until then. Except where required by law, payments are non-refundable and we do not provide refunds or credits for partial billing periods. California residents: you may cancel your subscription and, if you cancel within the timeframes required by California law after first subscribing, request a refund as provided by applicable law.

4.4 Taxes

Quoted prices may exclude taxes. You are responsible for any applicable sales, use, or similar taxes, which we may collect where required.

SECTION 5Your Content

5.1 You Own Your Stories

You retain all rights, title, and interest in the creative content you create or upload to the Service, including plots, scenes, characters, outlines, notes, and text (“Your Content”). Nothing in these Terms gives us ownership of Your Content. Your stories are yours.

5.2 License to Us

So that we can operate the Service, you grant Plot-on a limited, worldwide, non-exclusive, royalty-free license to host, store, reproduce, display, and transmit Your Content solely as necessary to provide, maintain, secure, and improve the Service, and as otherwise permitted by our Privacy Policy. This license ends when you delete Your Content or your account, except to the extent copies remain in routine backups for a limited period or we are required to retain them by law.

5.3 Your Responsibilities

You are solely responsible for Your Content and represent that you have all rights necessary to submit it. You should maintain your own backup copies of work that matters to you; while we work hard to protect your data, no online service can guarantee against loss.

SECTION 6Acceptable Use

You agree not to misuse the Service. In particular, you will not:

  • Use the Service for any unlawful purpose or in violation of these Terms;
  • Upload content that infringes the intellectual property or other rights of any person;
  • Upload content that is unlawful, or that sexualizes or exploits minors in any form;
  • Attempt to probe, scan, or breach the security of the Service, or access accounts or data belonging to others;
  • Interfere with the operation of the Service, including by introducing malware, scraping at scale, or imposing an unreasonable load on our infrastructure;
  • Reverse engineer, decompile, or resell the Service, or use it to build a competing product;
  • Use automated means to create accounts or access the Service except through interfaces we provide;
  • Circumvent plan limits or share Paid Plan access outside your account.

We may investigate violations and remove content, suspend, or terminate accounts that violate this section.

SECTION 7AI Features

7.1 How AI Features Work

The Service includes or may include features that use artificial intelligence to help you plot and develop stories, such as generating suggestions, text, or story structure (“AI Features”). When you use AI Features, the input you provide and relevant portions of Your Content may be processed by third-party AI service providers on our behalf, subject to our Privacy Policy and contractual confidentiality obligations.

7.2 AI Output

As between you and Plot-on, and to the extent we hold any rights in it, we assign to you any output generated for you by AI Features (“AI Output”). You are responsible for how you use AI Output. Be aware that: (a) AI Output may be inaccurate, incomplete, or similar to output generated for other users; (b) the extent to which AI-generated material can be protected by copyright is unsettled and varies by jurisdiction; and (c) you should review AI Output before relying on or publishing it.

7.3 AI Use Restrictions

You may not use AI Features to generate content that violates Section 6, to develop competing AI models, or in violation of any usage policies of our AI providers that we make available to you. We do not use Your Content to train AI models without your consent.

SECTION 8Our Intellectual Property

The Service itself — including its software, design, logo, brand, and all content we provide (excluding Your Content and AI Output) — is owned by Plot-on or its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable, revocable license to use the Service for its intended purpose in accordance with these Terms. You may not use the Plot-on name, logo, or branding without our prior written permission.

SECTION 9Feedback

If you send us ideas, suggestions, or feedback about the Service, you grant us a perpetual, irrevocable, royalty-free license to use them without restriction or compensation to you.

SECTION 10Copyright Complaints (DMCA)

We respect intellectual property rights and respond to notices that comply with the Digital Millennium Copyright Act. If you believe content on the Service infringes your copyright, send a notice containing the information required by 17 U.S.C. § 512(c)(3) to our designated agent at legal@plot-on.com. We may remove allegedly infringing content and terminate the accounts of repeat infringers.

SECTION 11Third-Party Services

The Service relies on third-party providers (for example, hosting, payment processing, fonts, and AI services) and may contain links to third-party websites. We are not responsible for third-party services or content, and your use of them may be subject to their own terms.

SECTION 12Termination

12.1 By You

You may stop using the Service or delete your account at any time in your account settings.

12.2 By Us

We may suspend or terminate your access to the Service if you materially breach these Terms, if required by law, or if we discontinue the Service. Where practicable, we will give you advance notice and a reasonable opportunity to export Your Content. If we terminate your Paid Plan without cause, we will refund the prorated unused portion of prepaid fees.

12.3 Effect of Termination

Upon termination, your license to use the Service ends. We may delete Your Content following account deletion or termination after a reasonable period. Sections that by their nature should survive (including Sections 5.2 (for the wind-down period), 8, 9, 13, 14, 15, and 16) survive termination.

SECTION 13Disclaimers

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, PLOT-ON DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE, THAT DATA WILL NOT BE LOST, OR THAT AI OUTPUT WILL BE ACCURATE OR FIT FOR YOUR PURPOSES. SOME JURISDICTIONS DO NOT ALLOW CERTAIN WARRANTY DISCLAIMERS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

SECTION 14Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW: (A) PLOT-ON WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUES, DATA, OR GOODWILL, ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS; AND (B) PLOT-ON’S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THE SERVICE OR THESE TERMS WILL NOT EXCEED THE GREATER OF (I) THE AMOUNTS YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE AND (II) FIFTY U.S. DOLLARS (US $50). THESE LIMITS APPLY REGARDLESS OF THE THEORY OF LIABILITY AND EVEN IF A REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THE ABOVE MAY NOT APPLY TO YOU.

SECTION 15Dispute Resolution: Arbitration and Class Action Waiver

PLEASE READ THIS SECTION CAREFULLY — IT REQUIRES YOU TO ARBITRATE DISPUTES INDIVIDUALLY AND WAIVES YOUR RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN CLASS ACTIONS.

15.1 Informal Resolution First

Before starting arbitration, you and Plot-on agree to try to resolve any dispute informally. Send a written description of your dispute to legal@plot-on.com; we will do the same to your account email. If the dispute is not resolved within 60 days, either party may proceed to arbitration.

15.2 Binding Arbitration

Any dispute arising out of or relating to these Terms or the Service will be resolved by binding individual arbitration administered by JAMS under its Streamlined Arbitration Rules, rather than in court, except that either party may (a) bring an individual claim in small claims court, or (b) seek injunctive relief in court for infringement or misuse of intellectual property rights. The Federal Arbitration Act governs this section. Arbitration will take place in the county where you reside or another mutually agreed location, or by videoconference. Plot-on will pay arbitration fees to the extent required by JAMS rules and applicable law for consumer disputes.

15.3 Class Action Waiver

YOU AND PLOT-ON EACH WAIVE THE RIGHT TO A JURY TRIAL AND THE RIGHT TO PARTICIPATE IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. Claims may be brought only on an individual basis. If this waiver is found unenforceable as to a particular claim, that claim (and only that claim) shall proceed in court.

15.4 30-Day Opt-Out

You may opt out of this arbitration agreement by emailing legal@plot-on.com within 30 days of first accepting these Terms, with your name, account email, and a clear statement that you opt out of arbitration. Opting out does not affect any other provision of these Terms.

SECTION 16Governing Law and Venue

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. For disputes not subject to arbitration, you and Plot-on consent to the exclusive jurisdiction of the state and federal courts located in California.

SECTION 17Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will notify you (for example, by email or an in-app notice) at least 30 days before the changes take effect, unless a change is needed sooner for legal or security reasons. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms. If you do not agree, stop using the Service and cancel your account before the changes take effect.

SECTION 18General

These Terms, together with our Privacy Policy and any plan-specific terms, are the entire agreement between you and Plot-on regarding the Service. If any provision is found unenforceable, the remainder stays in effect. Our failure to enforce a provision is not a waiver. You may not assign these Terms without our consent; we may assign them in connection with a merger, acquisition, or sale of assets. Nothing in these Terms creates a partnership, agency, or employment relationship. Notices to you may be sent to your account email; notices to us should go to legal@plot-on.com.
